August 23, 2007 -- Attorney General Paul Morrison today challenged the constitutionality of Kansas’ new expanded gaming statute. The lawsuit was filed with the Kansas Supreme Court.
In May, Governor Kathleen Sebelius suggested a lawsuit would help settle the issue and make way for future investments. After reviewing the statute, Morrison agreed.
“It is critical that this constitutional question be answered by the Kansas Supreme Court quickly,” Morrison said. “Investors and communities must be able to plan and move forward with economic development related to expanded gaming.”
The state’s brief focuses on the definition of a “state owned and operated lottery.” The court is asked to determine whether the legislature adhered to the constitutional amendment allowing a “state owned and operated lottery” when they wrote and passed the expanded gaming bill.
