Consumer Corner: Rising gas prices not always price gouging

Dear Attorney General,

Gas prices seem very high. It seems to me that gas stations are raising their prices to whatever suits them. How can I be sure I am not being taken advantage of at the pump?


Dear Kansas Consumer,

Gasoline prices are determined by supply and demand. The more gas we use typically translates into a somewhat lower supply and subsequent higher prices. This is especially true during the summer months when more people are traveling.

In the past few weeks, my office has received several complaints about price gouging and gas prices. In general, price gouging is defined as a dramatic increase in prices for goods or services in short supply following an emergency situation or disaster.

Kansas law specifically prohibits price gouging and my office will investigate and prosecute any businesses in violation of this law. However, regular fluctuations in the price of gas that are similar to other stations in the area do not qualify as price gouging.

Unfortunately, the Kansas Attorney General’s Office has no regulatory authority over the gas and oil companies that establish the price of gasoline. I encourage all consumers to contact their U.S. Representatives and Senators to express their concerns and opinions on federal regulation of the fuel industry.

I also encourage Kansas consumers to do what they can to limit their fuel use during this time of high demand. Simple tips like planning your day to eliminate unnecessary driving, carpooling, using public transportation, checking your air filter and keeping your tires properly inflated can go a long way in reducing the financial burden of increasing gas prices.
