TOPEKA - (April 3, 2024) - Kansas Attorney General Kris Kobach today announced that a federal judge blocked a Biden Administration attempt to drive gas-powered cars off the road.
As part of a 21-state coalition, Kobach brought a challenge in the U.S. District Court for the Western District of Kentucky against a Federal Highway Administration’s rule that would have forced states to reduce CO
2 emissions on the roads.
"President Biden's administration is constantly exceeding its authority. Once again, Republican attorneys general have stepped in to prevail over the Biden bureaucracy," Kobach said.
If the Federal Highway Administration’s rule had not been struck down, it would have required states to set targets to reduce greenhouse gas emissions from on-road sources. Multiple states commented that the FHWA rule could eliminate future economic development and job creation projects.
Kentucky Attorney General Russell Coleman led the coalition in the FHWA suit. In addition to Kobach, attorneys general from Alabama, Alaska, Arkansas, Florida, Idaho, Indiana, Iowa, Mississippi, Montana, Nebraska, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Utah, Virginia, West Virginia and Wyoming also joined the coalition.
